Establishment of a Migratory Tax to entry into Argentina by reason of tourism or business

On October 9th, 2008, the Official Gazette published decree No 1,654/2008 (hereinafter the "Decree") of the National Executive Power which creates the migratory duty to entry into Argentina by reason of tourism or business (hereinafter the "Migratory Tax") for nationals of countries that requires to the Argentine citizens the payment of a tax for the application and/or obtaining of consular visa.

The Decree was enacted by the Argentine Government for reestablishing the reciprocity between States as it affects those states that require Argentine citizens with procedures and duties to obtain the consular visa.

The main points of Decree are:

  • The Migratory Tax will apply to those foreign citizens who are exempted from Argentine consular visas by reason of tourism or business, and who are nationals of countries that require to Argentine citizens the payment of a tax and/or obtaining consular visa for admission to their respective territories.

  • The Migratory Tax should be paid at the time of entering the Argentine Republic.

  • The amount of the Migratory Tax will be the amount in pesos equivalent to the value of the tax that must pay the Argentine citizens for the visa application in the relevant country.

  • For the purpose of the conversion of the amounts into pesos it will be used the exchange rate established by the Banco de la Nacion Argentina, corresponding to the operations of the working day immediately preceding to the entry of the foreign to the Argentine territory.

Finally, the Decree provides that the funds received from the Migratory Tax will be allocated to the computerization and innovation in managing of the migration process, provision of resources and technical supplies, as well as maintenance and modernization of infrastructures in the checkpoints installed at the border air, land, sea and river.

This Decree shall enter into force the eighth day since its publication in the Official Gazette.
